The lawsuit was filed in federal court in Manhattan on Wednesday night, two and a half months after Peloton launched its clothing brand following the end of its five-year co-branding relationship with Lululemon, a division that Peloton called friendly

But Peloton said its products and Lululemon's designs are easy to distinguish, and Lululemon's designs are too "obvious" to deserve patent protection.

“In addition to the many clear and obvious differences in design, the Peloton and Lululemon marks and logos are also distinctive and well-recognized, making confusion between products a virtual impossibility,” Peloton said.
Peloton wants a court declaration that it did not infringe Lululemon's patents and trade dress, and that Lululemon's patent claims are invalid.
"At Lululemon, we're known for our product innovation and iconic design," Lululemon said in a statement on Friday. We will defend our property rights, protect the integrity of our brand, and protect our intellectual property."

By late morning, shares of Peloton were up $1.76, or 4%, at $45.68, as investors feared a new strain of the coronavirus would spread and keep more people home longer. .
